I lost the will to be angry already...

At last I see there is no point being too angry...Glad I am no longer angry over small small stuff...

What's the point being so emo over everything? This will only harm you and yourself alone... So? reflect over what happened..and I am not saying we should not be emo - I can get really emo at times especially when I cannot control my emotions well - I suppose everyone does! My point here is...Don't get too emotional over EVERYTHING until you become such a negative person all the time..

[22] Pihak pemohon telah menimbulkan tiga isu utama untuk mencabar perintah tahanan sebagai tidak sah, iaitu:

(a) perintah tahanan yang dibuat oleh Menteri Keselamatan Dalam Negeri dibawah s 8 AKDN tidak sah kerana tiada siasatan dibuat di bawah s73 ISA                              

(b) sama ada s 73 dan s 8 AKDN adalah 'inextricably connected';

(c) ketakpatuhan prosedur kepada s 11(2)(b) AKDN dan k 3(1) Kaedah-Kaedah

Lembaga Penasihat 1972.

[23] Adalah jelas bahawa perintah tahanan yang dikeluarkan, ia dibuat oleh Menteri Keselamatan Dalam Negeri dibawah s 8(1) AKDN tanpa siasatan di bawah s 73 AKDN.

[24] Satu kes penting yang berkaitan dengan kedudukan di atas adalah kes Mohd Ezam Mohd Nor v Ketua Polis Neaara [2002] 4 MLJ 449 di mana dalam kes berkenaan, pemohon telah ditahan di bawah s 8(1) AKDN tanpa proses siasatan di bawah s 73 AKDN.

[25] Di dalam kes yang diputuskan oleh Mahkamah Persekutuan tersebut, Steven Shim (CJ Sabah dan Sarawak) menyatakan, antara lain:

Inextricably connected' would mean that mean that ss 73(1) and 8 are

wholly dependant on each other. In the court's view, such a proposition

would have the effect of inhibiting or restricting the unfettered

discretion of the Minister. It would mean that the minister could not,

on his own and independent of the police, conduct any investigation or

take into consideration of the police, conduct any investigation or

take into consideration factors extraneous to those arising from police

investigation under s 73. What matters of national interest are

infinitely varied. So are matters of national security of the State.

These are the concerns of the Minister. In the exercise of his

discretion, he need not necessarily have to consider and rely on police

investigation. This is implicit in the very nature of an unfettered

discretion. 


Furthermore, police investigation under s 73 may stop short

of submission or reference to the minister where circumstances reveal

insufficient evidence to warrant the continued detention of the

detainee. Clearly, if it was the [*133] intention of Parliament

to impose a mandatory obligation on the part of the Minister to

consider the police investigation under s 73 before he could issue a

detention order under s 8, Parliament would have expressly provided for

it, but such express provisions are absent in ss 8 or 73 of the ISA,

thus although ss 73(1) and 8 are connected, they can nevertheless

operate quite independently of each other under certain circumstances.

In the circumstances, it cannot therefore be said that they are '

inextricably connected'.

[26] Menerima pakai keputusan kes di atas, saya putuskan bahawa s 8 AKDN adalah bebas dan boleh berdiri dengan sendirinya, tanpa merujuk kepada s 73 AKDN. Ini adalah kerana s 8 memberi kuasa kepada Menteri Keselamatan Dalam Negeri sendiri untuk membuat suatu perintah tahanan tanpa siasatan di bawah s 73 AKDN. JelasParlimen telah memberikan kuasa tersebut secara nyata tanpa perlu menjalani proses siasatan. Jika tidak, sudah tentu

juga Parlimen akan menyatakan sebaliknya. Oleh itu, perintah tahanan yang dibuat di bawah s 8(1) adalah sah dan terpakai.

[27] Di dalam kes Ketua Polis Negara v Abdul Ghani Haroon [2001] 4 MLJ 11, Haidar FCJ menyatakan, antara lain:

Section 73 of the ISA cannot be divorced from s 8 of the ISA. This is

what Salleh Abbas LP said in Tan Sri Raja Khalid bin Raja Harun at

p 86:

The arrest and detention under s 73(1) is pending inquiries to

see if an order under s 8 should be made by the Minister. It is

celar from the language of the two sections that s 73 provides

for initial detention and cannot be divorced from s 8 of the Act

which provides for the final detention.

[28] Namun begitu, keputusan kes Abdul Ghani Haroon tidak langsung dirujuk oleh Mahkamah Persekutuan di dalam kes Ezam walaupun Hakim Steve Shim dan Abdul Malek Ahmad yang menjadi panel turut sama dalam kes Ezam. Oleh itu, saya putuskan kes Ezam patut diikuti oleh mahkamah ini dan bukan keputusan kes Abdul Ghani Haroon.

[29] Daripada afidavit jawapan Menteri Keselamatan Dalam Negeri (lampiran 10) adalah jelas bahawa beliau telah menimbangkan dan mengambilkira faktor-faktor penting sebagai asas untuk membuat keputusan perintah tahanan.

Should s 8 be read together with s 73 ISA 1960???

Seksyen 73(1) Akta Keselamatan Dalam Negeri 1960 berbunyi: "Any police officer may without warrant arrest and detain pending enquiries any person in respect of whom he has reason to believe that there are grounds which would justify his detention under section 8; and that he has acted or is about to act or is likely to act in any manner prejudicial to the security of Malaysia or any part thereof or to maintenance of essential services therein or to the economic life thereof."

Seksyen 8 pula adalah tentang kuasa untuk mengarahkan penahanan atau sekatan ke atas seseorang. "(i) If the Minister is satisfied that the detention of any person is necessary with a view to preventing him from acting in any manner prejudicial to the security of Malaysia or any part thereof or to the maintenance of essential services therein or the economic life thereof, he may make an order (hereinafter referred to as a detention order) directing that that person be detained for any period not exceeding two years."

Seksyen 73 memberi kuasa yang luas kepada polis untuk membuat penangkapan terhadap individu yang dipercayai boleh atau telah memudaratkan keselamatan negara.

Seksyen 8 membolehkan Menteri Dalam Negeri mengeluarkan satu perintah tahanan selama dua tahun terhadap mana-mana individu yang penahanannya dianggap perlu oleh menteri bagi tujuan mencegahnya daripada bertindak dengan apa-apa cara yang boleh memudaratkan keselamatan negara.

Penahanan 60 Hari di bawah Kuasa Polis

Seksyen 73 memberi kuasa yang amat luas kepada polis untuk membuat penangkapan tanpa waran terhadap sesiapa yang disyaki boleh dikenakan perintah tahanan dua tahun di bawah seksyen 8.

Pihak polis hanya perlu mempunyai sebab untuk percaya bahawa seseorang itu telah bertindak atau mungkin bertindak mengancam keselamatan negara untuk membolehkan tangkapan tersebut dilakukan.

Moments I enjoy the most in my life..

PERKEB is great...I always have my refreshing moments with you guys.. One of the thing that I will not regret in life is to be with the PERKEBIANS always... The overflowing joy affecting everyone.. No matter how tension is everyone, when we meet up, everyone tend to be so happy..It's really a joy...Indeed the goodness of GOD has brought us together..and I can still hang on until today is because I  know GOD has  brought you guys into my life..

IS IT FAIR??

I have always believe that nothing is fair on this earth and only GOD is fair..but  I cannot help it when there are pretty ones there and the less pretty one gotta receive all the STINGS.. I will be so angry with GOD and hey...what is this man!! People who's pretty and intelligent get everything in their life and receives unending favour..just sadden me.. I am okie if the less pretty ones don't receive stings from people but unfortunately, sometimes the look at people's face seems to tell the less pretty one ,"You don't even deserve a place on this earth..."

I have that feeling that I am a lawyer now...It's exciting being able to solve a case... indeed it's just so exciting...if only I can get my own secretary one day...

Some people really always have the tendency to forget to use their brains especially during emergency..

I don't pity those who die because they have something to die for but rather I pity those who don't have something to die for...

Am actually wondering.. I guess I pity those who commit suicide because they don't know what opprtunity lies ahead of them...They might just come out with a brilliant idea sometimes if they continue to live...I mean- sometimes we talk things that don't make sense but sometimes we can really think of brilliant ideas..Isn't it comforting to have someone who tell you that your ideas are just so brilliant and they admire you for that?

Goshhhhhh.....I just love that feeling... =)

I will never understand why killing is happening all over the world... It's really really sad...So many happenings all around the world... None of us can survive in this world without YOU...Lead me always and forever...Guide me..I don't want to choose the wrong path in my life.. Teach me.

I no longer know how to discern between right and wrong nowadays..Things that I thought was right seems to be wrong and things seems to be wrong in my eyes are right to someone else's eyes...

Someone asked me the other day..."Did I actually fell down from heaven??" Hmmmm...Well, how to answer that. I suppose convent girls seem still keep their moral values..I cannot imagine if I disappoint my moral teacher..It's not that I am an angel here..but I guess things are getting harder as a law students..

Thank GOD!

I am really really grateful to God today...I was so tired after ALSA conference today...It ends at around 3.45pm..When I reached my room, it's around 4pm. Then, there's no electricity until 8pm!!!!! Arghhhhhhhh!!!!!! I could not be bothered to go out...So I stayed in my room studying although it's hot like crazy! Guess what? I keep telling myself to study.. to study despite the weather..I managed to and it's like God understands me...A few moments later, I hear some sound...N hey...The fan functions!!! Wohooooooo!!!! I was so happy and I went to sleep because I was too tired...
